Terms and Conditions
Total Cycle Assist has been designed to be fully inclusive for all your immediate family together with all the bicycles (regardless of type or value) owned by your immediate family. Therefore, your Total Cycle Assist membership includes your spouse/partner and all your children up to the age of 21 who live with you (which includes students up to the age of 21 who live away from home temporarily during the course of their studies) and all the cycles owned and ridden by them will be fully covered.
In the event of you or any member of your immediate family being involved in an accident within the UK that's not your fault (or the fault of the member of your immediate family who has had the accident) where there is an identified at-fault third party which has resulted in injuries for which damages are likely to exceed £1,000 for which you choose to bring a personal injury claim with our solicitors, the following services will be available to you:
Our specialist solicitors will provide you with comprehensive legal support. You will keep up to100% of your compensation award. We at Assist Protect Limited will never deduct anything from your compensation.
The solicitor/client relationship between you and our specialist solicitors is governed by the conditional fee agreement and other terms and conditions outside the ambit of this document and will be explained to you fully and transparently and in plain English by these solicitors from the start of your claim.
Your cycle will be repaired by whichever of our Trusted Repairers is closest to where you live and we shall pay for these repairs upon full admission of liability by the third party's insurers.
Once in the hands of the repairers the damage to your cycle will be assessed and a decision made:
(1) is your cycle repairable? or
(2) is your cycle damaged beyond repair?
If the cycle is repairable, then it will be repaired free of charge and you will not even be required to pay any excess in order for the repairs to be completed. If the cycle is not repairable, then you will be entitled to a replacement cycle.
The cost of the repairs will be recovered by us from the at-fault party's insurer as an integral part of our service where you (or your spouse/partner or your child up to the age of 21) are not at fault for the accident.
If your own cycle is damaged beyond repair you will be entitled to a brand new replacement where this new cycle is of the same value as your own and we shall pay for the replacement cycle upon full admission of liability by the third party's insurers.
We will liaise with the cycle repair technicians and obtain their expert and honest evaluation as to what a brand new cycle that's on a like-for-like equivalent basis to your own would cost. Once we have been told that value we will issue you a voucher in your name for that amount which we will post to your home address. You then need only return to the cycle repair shop where you took your damaged cycle with this voucher and collect the new cycle of your choice.
You may, however, if you choose, use the voucher in part payment towards a more expensive cycle. In other words if the amount stated on the voucher is, say, £800, and you wish to collect a new cycle priced at £1,000 you need only pay £200 in cash yourself and the balance of £800 is satisfied by the voucher.
The cost of the replacement cycle will be recovered by our solicitors from the at-fault party's insurer as an integral part of their personal injury claim service, so there is not even an excess for you to pay.
Whomever in your immediate family is injured will be entitled to our private-clinic physiotherapy and rehabilitation treatment upon full admission of liability by the third party's insurers.
Based upon your GP's recommendations, backed up by our telephone triage session, you will be referred to one of our private physiotherapist and rehabilitation professionals. This clinic will always be local to where you live to ensure your maximum convenience.
You can inform us about any cycling accident either by phone, email or via our contact page, whichever you prefer. Your membership documentation includes all of this information.
Our straightforward and clear process is designed from start to finish to make your life simple:
- We'll handle all the communication with the at-fault party's insurer
- We'll take care of all the paperwork and administration for you
- We'll arrange for all the repairs or replacement of your cycle
As a Total Cycle Assist member you don't have to concern yourself with the usual inconvenience and hassle of the claim process. Everything that needs to be done will be done by people trained to do it while you're kept fully and regularly informed on progress. In short, one call does it all.
From time to time it will be necessary for us to email you in order to keep you informed of any upgrades you're entitled to, discounts, special offers, changes to your policy, renewal notification and so on and by clicking the box on our joining page to confirm that you have read and understand these Terms and Conditions you are giving us your consent that we may communicate with you via email in order to keep you informed of these important matters.
We adopt a zero tolerance policy when it comes to fraud. We will not hesitate to press criminal charges and, if appropriate, make a civil claim against you as well for recovery of monies paid
out by ourselves and legal costs if we find that you have deliberately mislead us and/or falsified information regarding the circumstances of your accident or any other matter
pertinent to the provision of our services to you and/or have in any other material way not acted with the same good faith as we ourselves act in our dealings with you for the purposes
of material gain (for example in order to obtain a new replacement cycle that you do not deserve based on the true circumstances).
